Terms of Service

Empowered House P.S.A. operates the Site and Service under the Empowered Intelligence brand. Empowered House P.S.A. is a simple joint-stock company (prosta spolka akcyjna) organized under the laws of Poland, VAT ID PL 7831958235, with its registered office at Droga Debinska 3A/3, 61-555 Poznan, Poland, and KRS 0001253770. Empowered Intelligence is built by EmpoweredHouse, a software company backed by Appunite.

• The Site is an informational and marketing website. It describes Empowered Intelligence and lets you book a walkthrough.
• The Service is the Empowered Intelligence product. It is a semantic layer and company model that connects to data you provide and answers analytical questions about your organization.

Access to the Service requires a separate written agreement, such as a pilot or subscription agreement, and an accompanying Data Processing Agreement. If those agreements conflict with these Terms regarding the Service, those agreements prevail.

We grant you a limited, non-exclusive, non-transferable, revocable right to use the Site for informational and evaluation purposes. You agree not to:

• Use the Site unlawfully or in breach of these Terms.
• Copy, scrape, or systematically extract content except as permitted by law.
• Interfere with the Site or attempt unauthorized access to it or related systems.
• Submit false information through any form.

Booking a walkthrough is a request to talk. It does not create any contract or obligation, and it does not grant access to the Service.

Personal data you submit is handled under the Privacy Policy.

If you are granted access to the Service:

• You are responsible for your account credentials and for activity under your account.
• You must have the right to connect any data you connect, and you remain the controller of that data. We act as your processor under the Data Processing Agreement.
• You must not use the Service to process data you are not authorized to process, or in breach of law or third-party rights.
• During a pilot or beta, the Service is provided on an evaluation basis: it may change or be withdrawn, and it is offered without the service levels, warranties, or support commitments of a paid subscription.

The separate agreement and DPA set out the detailed terms for fees, service levels, security commitments, and data handling.

We or our licensors own the Site, the Service, the Empowered Intelligence and Shugyo names and marks, software, models, and content. Intellectual property law protects them. We grant no rights other than those expressly stated. You retain all rights in the data you connect; we claim no ownership of it.

Feedback you provide about the Site or Service may be used by us without restriction or obligation to you.

The Service connects to third-party platforms, such as cloud data warehouses and AI providers. The Site also links to external sites, including EmpoweredHouse (empowered.house). We are not responsible for third-party services or sites, and your use of them is subject to their own terms.

The Site and, except as expressly stated in a separate signed agreement, the Service are provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law, including fitness for a particular purpose, accuracy, and non-infringement. AI-generated outputs may be incomplete or incorrect and should be reviewed before being relied on. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from use of the Site or Service. Any liability cap for the paid Service is set out in the separate agreement. Nothing limits liability that cannot be limited under applicable law.

We may change the Site, the Service, and these Terms. The current version and its effective date are posted on this page. Continued use after a change means you accept the updated Terms.

These Terms are governed by the laws of Poland. Any dispute arising out of or in connection with these Terms shall be resolved by arbitration before the Court of Arbitration at the Lewiatan Confederation (Sad Arbitrazowy przy Konfederacji Lewiatan) in Warsaw, in accordance with its rules, unless mandatory law provides otherwise. The seat of arbitration is Warsaw, Poland; the language is English. Terms governing disputes about the paid Service may be set out differently in the separate signed agreement, which prevails for the Service.
